Hiring Workers On Shabbat For After Shabbat

The Daily Halacha Moment - Hiring Workers On Shabbat For After Shabbat ⚒

״כל השונה הלכות בכל יום - מובטח לו שהוא בן העולם הבא״ (נידה עג ע״א, מגילה כח:)

“Anyone who studies Halachot every day is guaranteed that he is destined for the world-to-come” (Megilla 28b, Niddah 73a)

Question:

May one hire workers on Shabbat for after Shabbat?

Answer:

One may not hire workers on Shabbat.[1] Similarly, one may not tell someone to be ready for him after Shabbat, if that person understands from this statement that he is intending on hiring him, such as one who needs a driver. However, it is permitted to tell him in a manner of a hint, such as by saying, “Can you stay with me until tonight?” — even though the person will understand that his services are needed after Shabbat.[2]

However, One may watch a non-Jew perform his work even though one’s intention is to learn the techniques of what the non-Jew is doing.[3] However, if such work requires one to concentrate to understand how to perform it himself, then one should not learn how to do this from a non-Jew on Shabbat.[4]

[2]. Shulchan Aruch 307:7. Petach HaDevir 307:5 explains that this is unlike one saying, “Be ready for me tonight".

[3]. Mishnah Berurah 340:21 states that one may only do so if one happened to be passing by and saw the non-Jew doing work. However, to go to the house of a non-Jew with the intention of learning from him is prohibited. On the other hand, Rabbi Chaim Palagi in Lev Chayim 3:67 states that it is permitted to even go to the house of a non-Jew in order to learn how to perform a certain work, since learning a trade in order to earn an honest living is considered a mitzvah. Nevertheless, he points out, that one should do so in a private setting. See also Kaf HaChayim 306:68; Chazon Ovadia, Shabbat, vol. 5, p. 152 and Shulchan Shlomo 306:17.
