Moving or Touching Muktzeh

The Daily Halacha Moment - Moving or Touching Muktzeh ⚽📱📸

״כל השונה הלכות בכל יום - מובטח לו שהוא בן העולם הבא״ (נידה עג ע״א, מגילה כח:)

“Anyone who studies Halachot every day is guaranteed that he is destined for the world-to-come” (Megilla 28b, Niddah 73a)

Question:

May one move or touch Muktzeh?

Answer:

Muktzeh is not only prohibited to be picked up, but it may also not be moved. [1]

However, one is permitted to touch muktzeh provided that the muktzeh *does not* move as a result of its being touched. [2]

It is permitted to move muktzeh with one’s body or a part of one’s body, in a manner other than carrying it in one’s hands,[3] even where the movement is for the benefit of the muktzeh. For instance, one may kick an item that is muktzeh machmat gufo to a place that is more secure. [4] Similarly, moving muktzeh by blowing at it is not included in the prohibition of moving muktzeh, and is permitted. [5]

Although it not permitted to move an item that is muktzeh, it is permitted to benefit from a muktzeh item, such as sitting on the item. Therefore, it is permitted to sit on a rock or log on Shabbat. [6]

Tomorrow we will B'ezrat Hashem discuss indirect movement of muktzeh.

However, Shulchan Aruch HaRav 308:52, Mishnah Berurah 308:82 and Kaf HaChaim 308:145 state that even if the item will move slightly when one is sitting upon it, it is permitted to sit on it since this is an indirect way of moving it, just one may not intentionally move it. However, an item that is muktzeh machmat mitzvah, may not even be sat upon since it is prohibited from deriving any benefit.
